Man accused of stealing guns, ammo, wins appeal

This week the 9th District Court of Appeals ruled that the state failed to prove all elements of the offense in a gun theft case, resulting in a new sentencing hearing for defendant Robert Johnson.

Johnson appealed from the judgment of the Lorain County Court of Common Pleas where he was indicted in August 2014 for theft in violation of R.C. 2913.02(A)(1).

The indictment alleged that the property stolen was a firearm or dangerous ordnance, elevating the crime to a third-degree felony. A firearm specification accompanied the charge.
