Court of appeals rules stop and search unwarranted

In Ohio’s Ninth District, a panel of three appellate judges recently reversed the judgment of the Summit County Court of Common Pleas when it ruled that the lower court should have granted a defendant’s motion to suppress evidence collected from an unlawful pat-down search.

According to case summary, James Cunningham was arrested when Akron police received an anonymous phone call indicating that a black male wearing jeans and a neon green shirt was selling heroin in the city’s Grace Park.
