Heroin-using truck driver loses appeal in 12th District Court

In an opinion released this week, the 12th District Court of Appeals affirmed drug convictions for a man who had heroin and syringes in his semi-truck and was reported as being “whacked out on drugs.”

Richard Durham appealed his conviction from the Warren County Court of Common Pleas, challenging his sentence and the officers’ right to question him and search his vehicle.

The three-judge appellate panel found that the officers’ actions were based on a phone call and report from Durham’s passenger, Latisha Lane Ingram.
