Sentence upheld for man who assaulted his stepson

The Ninth District Court of Appeals affirmed the conviction of Gerald Smith in the Summit County Court of Common Pleas this week for the assault of his stepson.

According to a summary of the case, Smith’s wife of 25 years decided to divorce him and she moved in with her son and Smith’s stepson, Darryl McNew.

When she left, Smith went to McNew’s house, pointed a .357 magnum at his chest and demanded to know where his wife was.
