Court rules 'community caretaking' allowed for police search in OVI case

When a police officer takes action as a community caretaker, those actions do not constitute an illegal search or seizure under the Fourth Amendment, according to a recent ruling from the 10th District Court of Appeals.

The appellate court recently affirmed the Franklin County Municipal Court’s decision denying Wendy Weese’s motion to suppress evidence and convicting her of operating a motor vehicle under the influence of alcohol or drugs.
