First District finds court costs are not part of a criminal conviction

In a per curiam decision released Wednesday, the First District Court of Appeals reversed the ruling of the Hamilton County Court of Common Pleas in a case concerning the expungement of a defendant’s conviction after her failure to pay court costs.

According to the appellate panel’s summary of the matter, Princella Ushery was convicted of minor misdemeanor possession of marijuana in 2005.

The Hamilton County court imposed a $150 fine as her sentence and assessed $85 in court costs.
