Appeals court rules lower court wrong in extending man's sentence

Published: 06/11/2013

The Franklin County Court of Common Pleas improperly reconsidered a valid final judgment and extended a man’s sentence by three days, a local appellate panel recently ruled.

The 10th District Court of Appeals found that the common pleas court had already issued Marqueith Simpson a valid judgment and sentence and could not, therefore, re-sentence him later.

Simpson pleaded guilty to charges of drug possession and aggravated menacing in September 2012.
