Justices rule man who refused work is not eligible for disability compensation

In a 7-0 decision Wednesday the Ohio Supreme Court affirmed a trial court’s denial of temporary total disability compensation to a man who refused work within his physical limitations.

“He presented no evidence of circumstances, new or changed, that would demonstrate a loss of wages as a result of (temporary total disability). The commission abused its discretion when it exercised continuing jurisdiction,” Ohio Supreme Court Justice Evelyn Lundberg Stratton wrote for the court.
